Terms & Conditions

Travel King International
Original Effective Date: January 15, 2000
Current Version Effective: May 28, 2026

These Terms and Conditions (the “Agreement”) constitute a binding legal contract between The Traveler Travel Agency, Inc., a Texas corporation doing business as Travel King International (“Travel King,” “we,” “us,” or “our”), and the individual, entity, or representative engaging Travel King’s services (“Client,” “you,” or “your”). By contacting Travel King to request services, confirming a booking, accepting an itinerary, making a payment, or using any service arranged by Travel King, Client expressly agrees to be bound by this Agreement in its entirety.

CLIENT IS ADVISED TO READ THIS AGREEMENT CAREFULLY. IT CONTAINS PROVISIONS THAT LIMIT TRAVEL KING’S LIABILITY, REQUIRE DISPUTES TO BE RESOLVED IN COLLIN COUNTY, TEXAS, SHORTEN THE TIME PERIOD FOR BRINGING CLAIMS, AND WAIVE CERTAIN RIGHTS THAT MAY OTHERWISE BE AVAILABLE TO CLIENT.

1. DEFINITIONS

1.1 “Booking” means any reservation, ticket, itinerary, or travel arrangement made by Travel King on behalf of Client.

1.2 “Supplier” means any third-party provider of travel-related products or services, including but not limited to airlines, cruise lines, hotels, resorts, tour operators, ground transportation providers, aircraft operators, charter operators, destination management companies, visa processing agencies, insurance carriers, and other travel service providers.

1.3 “Services” means the services described in Section 2 below.

1.4 “Service Fees” means amounts charged by Travel King to Client for arranging, coordinating, or facilitating Bookings, separate and apart from amounts charged by Suppliers.

1.5 “Traveler” means the individual person or persons traveling on a Booking, who may or may not be the same as Client. Where Client is a corporate entity or other organization booking travel on behalf of an individual, both Client and Traveler are bound by the obligations set forth in this Agreement that apply to whoever is traveling, including but not limited to obligations regarding travel documentation, reconfirmation, airport arrival, and compliance with Supplier and governmental requirements. Client is responsible for ensuring that Travelers booked through Travel King are informed of and comply with this Agreement.

2. SCOPE OF SERVICES AND AGENCY RELATIONSHIP

2.1 Travel King is a full-service luxury travel agency providing the following Services: airline ticketing; hotel and resort reservations; cruise bookings; tour and itinerary planning; private and group tour arrangements; private jet charter brokerage; corporate travel management; visa and passport processing; entertainment and group travel coordination; and related concierge services.

2.2 Travel King acts solely as an independent booking agent on behalf of Client in arranging Services provided by Suppliers. Travel King is not a Supplier, does not own or operate any aircraft, vessel, hotel, vehicle, or other travel service, and is not responsible for the acts, omissions, defaults, or performance of any Supplier.

2.3 With respect to private jet charter, Client expressly acknowledges that Travel King operates exclusively as a broker. Travel King does not own, operate, lease, or control any aircraft and does not employ any flight crew. All flight operations are performed by independent Federal Aviation Administration (FAA) Part 135 certificated air carriers. Travel King’s sole role is to arrange charter services on Client’s behalf with such operators.

2.4 Each Supplier has its own terms and conditions, including conditions of carriage, cancellation policies, refund policies, limitation of liability provisions, and other restrictions. Such Supplier terms apply to Client’s Booking in addition to this Agreement. In the event of conflict between Supplier terms and this Agreement regarding Supplier-provided services, the Supplier’s terms control. Client agrees to review and abide by all applicable Supplier terms.

3. BOOKING, CONFIRMATION, AND ACCEPTANCE

3.1 A Booking is formed when Travel King issues a confirmation, ticket, itinerary, or invoice to Client following Client’s request for services, regardless of whether payment has been received.

3.2 Client agrees that submission of a booking request, acceptance of an itinerary or quote, oral or written confirmation of a Booking, or payment for any service constitutes Client’s acceptance of this Agreement.

3.3 Client is solely responsible for reviewing all Booking confirmations, itineraries, tickets, and other documents immediately upon receipt and notifying Travel King within twenty-four (24) hours of any errors, including but not limited to misspelled names, incorrect dates, incorrect routing, or other inaccuracies. Travel King is not responsible for any costs, losses, or consequences arising from Client’s failure to review and notify Travel King of errors within this timeframe.

4. PAYMENT TERMS, LATE FEES, AND COLLECTION

4.1 Payment in full is due upon confirmation of a Booking unless an alternate payment schedule is expressly stated in writing by Travel King for a specific Booking. Client acknowledges that Travel King may advance payment to Suppliers prior to receiving payment from Client, and that any failure by Client to remit payment promptly causes Travel King to bear financial carrying costs on such advances.

4.2 Travel King accepts payment by Zelle, cash, cashier’s check, wire transfer, and credit card. All credit card payments require a completed and signed credit card authorization form. Client represents and warrants that Client is the authorized user of any payment method used for any Booking.

4.3 Travel King charges a non-refundable service fee for each Booking, the amount of which is disclosed at the time of Booking. The service fee compensates Travel King for arranging, coordinating, and facilitating the Booking and is earned upon issuance of the Booking, regardless of whether the Booking is subsequently used, modified, or cancelled.

4.4 Any invoice or balance remaining unpaid more than thirty (30) days past the due date is considered delinquent and in default.

4.5 DELINQUENT BALANCES ARE SUBJECT TO INTEREST AT THE RATE OF EIGHTEEN PERCENT (18%) PER ANNUM, OR THE MAXIMUM RATE ALLOWED BY TEXAS LAW, WHICHEVER IS LESS, CALCULATED FROM THE ORIGINAL DUE DATE UNTIL THE BALANCE IS PAID IN FULL.

4.6 DELINQUENT BALANCES ARE FURTHER SUBJECT TO A FLAT ADMINISTRATIVE LATE FEE OF ONE HUNDRED DOLLARS ($100.00) FOR EACH MONTHLY BILLING CYCLE THE INVOICE REMAINS UNPAID. CLIENT ACKNOWLEDGES AND AGREES THAT THIS FEE REPRESENTS A REASONABLE PRE-ESTIMATE OF THE ACTUAL ADMINISTRATIVE COSTS INCURRED BY TRAVEL KING IN PURSUING EACH DELINQUENT BALANCE, INCLUDING WITHOUT LIMITATION: (A) FINANCIAL CARRYING COSTS, AS TRAVEL KING HAS TYPICALLY ADVANCED PAYMENT TO SUPPLIERS PRIOR TO RECEIVING CLIENT PAYMENT AND BEARS INTEREST COSTS ON SUCH ADVANCES; (B) STAFF TIME SPENT ON DEMAND LETTERS, PHONE CALLS, EMAIL CORRESPONDENCE, AND COLLECTION FOLLOW-UP; (C) ACCOUNTING AND BOOKKEEPING COSTS RELATED TO TRACKING THE DELINQUENT ACCOUNT; AND (D) OPPORTUNITY COSTS OF DIVERTED RESOURCES. THESE COSTS ARE INHERENTLY DIFFICULT TO QUANTIFY PRECISELY ON A PER-INVOICE BASIS AND THE FLAT FEE REPRESENTS A REASONABLE LIQUIDATED DAMAGES AMOUNT, NOT A PENALTY.

4.7 In the event Travel King is required to take any action to collect a delinquent balance, Client agrees to pay all costs of collection incurred by Travel King, including but not limited to reasonable attorney’s fees, court costs, collection agency fees, process server fees, and other reasonable expenses, in addition to the principal amount owed, accrued interest, and administrative late fees. Such collection costs are recoverable pursuant to Texas Civil Practice and Remedies Code §38.001 and the contractual terms of this Agreement.

4.8 All payments received from Client are first applied to outstanding collection costs, then to administrative late fees, then to accrued interest, and finally to the principal balance owed.

4.9 Travel King reserves the right to refuse to confirm, issue, or honor any new Booking for any Client with an outstanding delinquent balance, and to cancel any pending Booking if amounts owed are not brought current. Travel King’s exercise of this right does not waive any other remedies.

5. CANCELLATION, CHANGES, AND REFUNDS

5.1 All Bookings are non-refundable and non-changeable unless expressly stated otherwise in writing by Travel King at the time of Booking confirmation.

5.2 Where a Supplier permits cancellation or changes, Client is responsible for all Supplier-imposed cancellation fees, change fees, fare differences, tax differences, and other charges. Travel King’s service fees are non-refundable under all circumstances, including but not limited to Client cancellation, Supplier cancellation, Booking modifications, force majeure events, or any other reason.

5.3 In the event of a Supplier refund to Travel King for a Booking on which a commission has been earned by Travel King, Travel King reserves the right to retain its service fee and any commission recall amount from the refund proceeds before remitting the balance to Client.

5.4 Travel King may charge additional service fees for processing cancellations, changes, modifications, rebookings, or refund requests. Such fees are disclosed at the time the request is made and are non-refundable.

6. CLIENT RESPONSIBILITIES AND TRAVEL DOCUMENTATION

6.1 Client is solely responsible for obtaining and maintaining all travel documentation required for Client’s itinerary, including but not limited to valid passports (with sufficient validity remaining and blank pages as required by destination countries), visas, entry permits, transit permits, residency documents, OCI cards, vaccinations, health certifications, COVID-19 or other testing documentation, and any other documents required by destination, transit, or departure countries.

6.2 Passports generally must be valid for at least six (6) months beyond the date of return travel. Client is responsible for verifying specific requirements for each destination and transit country.

6.3 Client is responsible for verifying all travel advisories, restrictions, health requirements, and entry requirements issued by relevant governmental authorities for each destination. Travel King may provide general guidance regarding such requirements as a courtesy but does not guarantee the accuracy, completeness, or current applicability of any such information.

6.4 Where Travel King facilitates visa or passport processing services, Travel King acts solely as an administrative facilitator submitting documents on Client’s behalf to the relevant government authority or authorized processing service. Travel King does not adjudicate visa applications and cannot and does not guarantee visa issuance, processing times, or outcomes. Government and processing fees are non-refundable regardless of outcome. Travel King’s service fees for visa and passport processing are non-refundable regardless of outcome.

6.5 Client is responsible for reconfirming all Bookings directly with Suppliers prior to travel. Recommended reconfirmation timing is at least twenty-four (24) hours prior to domestic departures and at least seventy-two (72) hours prior to international departures. Client is also responsible for arriving at airports, ports, and other departure points at the times required by the Supplier. Recommended airport arrival times are at least two (2) hours prior to domestic departures and at least three (3) hours prior to international departures. Travel King is not responsible for any losses arising from Client’s failure to reconfirm or timely arrive.

6.6 Client is responsible for ensuring that names on all Booking documents exactly match Client’s government-issued travel identification. Travel King is not responsible for losses arising from name discrepancies that Client did not identify and report to Travel King within the timeframe set forth in Section 3.3.

7. TRAVEL PROTECTION AND INSURANCE

7.1 Travel King strongly recommends that every Client purchase comprehensive travel protection and insurance coverage for each Booking. Such coverage may include trip cancellation insurance, trip interruption insurance, baggage protection, medical coverage, evacuation coverage, and related protections.

7.2 Travel King makes travel insurance available to Client through third-party insurance providers and includes information regarding insurance with each Booking. Client acknowledges that travel insurance is offered with every Booking arranged by Travel King.

7.3 CLIENT EXPRESSLY ACKNOWLEDGES THAT BY BOOKING WITH TRAVEL KING AND ACCEPTING THIS AGREEMENT, CLIENT IS DEEMED TO HAVE BEEN OFFERED TRAVEL INSURANCE, INCLUDING OPTIONAL CANCEL FOR ANY REASON (CFAR) COVERAGE. ANY CLIENT WHO DOES NOT PURCHASE TRAVEL INSURANCE THROUGH TRAVEL KING OR DIRECTLY FROM A THIRD-PARTY PROVIDER IS DEEMED TO HAVE DECLINED SUCH COVERAGE AND ASSUMES ALL RISKS OF LOSSES THAT WOULD HAVE BEEN COVERED BY APPROPRIATE TRAVEL INSURANCE, INCLUDING BUT NOT LIMITED TO LOSSES RELATED TO MEDICAL EMERGENCIES, TRIP CANCELLATION, TRIP INTERRUPTION, LOST OR DELAYED BAGGAGE, CANCELLATIONS FOR REASONS NOT COVERED BY STANDARD POLICIES, AND OTHER COVERED LOSSES. SOME CREDIT CARDS AND CORPORATE TRAVEL PROGRAMS PROVIDE LIMITED TRAVEL PROTECTIONS, AND IT IS SOLELY CLIENT’S RESPONSIBILITY TO VERIFY THE SCOPE AND ADEQUACY OF ANY SUCH COVERAGE. TRAVEL KING MAKES NO REPRESENTATION REGARDING THE AVAILABILITY OR SUFFICIENCY OF CARD-BASED OR EMPLOYER-PROVIDED PROTECTIONS.

7.4 Travel King acts solely as a referral source to third-party insurance providers and is not a licensed insurance agent, broker, or carrier. All insurance contracts are between Client and the insurance provider directly. Travel King makes no representations or warranties regarding the coverage, terms, exclusions, or claims handling of any insurance product.

7.5 Travel King has no liability for any Client loss that would have been covered by travel insurance Client declined to purchase.

8. LIMITATION OF LIABILITY

8.1 TRAVEL KING’S TOTAL LIABILITY TO CLIENT FOR ANY CLAIM ARISING OUT OF OR RELATED TO ANY BOOKING, SERVICE, OR THIS AGREEMENT, REGARDLESS OF THE FORM OF ACTION OR THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), SHALL NOT EXCEED THE LESSER OF: (A) THE TOTAL SERVICE FEES ACTUALLY PAID BY CLIENT TO TRAVEL KING FOR THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM, OR (B) FIFTY DOLLARS ($50.00).

8.2 IN NO EVENT SHALL TRAVEL KING BE LIABLE TO CLIENT OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST BUSINESS OPPORTUNITY, LOSS OF GOODWILL, LOSS OF DATA, EMOTIONAL DISTRESS, LOSS OF ENJOYMENT, MISSED EVENTS, MISSED CONNECTIONS, OR ANY DAMAGES ARISING FROM DELAY, CANCELLATION, OR DISRUPTION OF TRAVEL, EVEN IF TRAVEL KING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.3 Travel King is not liable for any act, omission, default, negligence, or failure of any Supplier or third party. Client’s sole remedy for any failure or deficiency in Supplier services is against the Supplier directly.

8.4 Travel King is not liable for any loss, damage, delay, injury, illness, or inconvenience arising out of or related to: (a) Supplier acts, omissions, defaults, or financial failures (including bankruptcy, insolvency, or cessation of operations); (b) Client’s acts or omissions, including failure to obtain required documentation, failure to arrive on time, or failure to comply with Supplier or governmental requirements; (c) force majeure events as defined in Section 9; (d) currency fluctuations, fare increases, or fuel surcharges imposed after Booking; (e) any loss that would have been covered by travel insurance Client declined to purchase; or (f) any third-party action, criminal act, or terrorism.

8.5 The limitations of liability in this Section 8 apply regardless of the cause of action and are essential elements of this Agreement. Client acknowledges that the Service Fees charged by Travel King would be substantially higher absent these limitations and that the limitations represent a reasonable allocation of risk between the parties.

9. FORCE MAJEURE

9.1 Travel King shall not be liable for any failure or delay in performance, or for any loss or damage of any kind, arising from any cause beyond Travel King’s reasonable control, including but not limited to: acts of God; natural disasters (including hurricanes, earthquakes, floods, wildfires, and volcanic activity); epidemics, pandemics, or public health emergencies; quarantines or government health orders; acts of war, terrorism, civil unrest, or insurrection; strikes, labor disputes, or work stoppages; government acts, regulations, restrictions, or sanctions; embargoes; airline, cruise line, or other Supplier failures, bankruptcies, or service disruptions; airport, port, or border closures; weather conditions; mechanical failures; cyber incidents; or any other event beyond Travel King’s reasonable control.

9.2 In any force majeure event, Client’s remedies are limited to whatever refunds or rebookings are made available by the relevant Suppliers. Travel King’s service fees remain non-refundable.

10. PRIVACY AND CONFIDENTIALITY

Client Privacy

10.1 Travel King collects personal information from Client only as necessary to facilitate Bookings and provide Services. Such information may include names, contact information, passport details, payment information, travel preferences, and itinerary details.

10.2 Travel King shares Client information with Suppliers only as necessary to fulfill Bookings, with payment processors as necessary to process payments, and as required by law (including but not limited to lawful government requests). Travel King does not sell Client personal information to third parties for marketing purposes.

10.3 Travel King maintains reasonable physical, technical, and administrative safeguards to protect Client information. However, no method of transmission or storage is completely secure, and Travel King cannot guarantee absolute security of Client information.

Confidentiality of Travel King Materials

10.4 Client acknowledges that itineraries, pricing structures, vendor relationships, supplier arrangements, recommendations, and other materials prepared by Travel King constitute Confidential Information and proprietary work product of Travel King. Client agrees not to share, publish, distribute, or otherwise disclose such Confidential Information to any competitor of Travel King or for any commercial purpose, without the prior written consent of Travel King.

10.5 Personal sharing of trip photographs, general destination experiences, and similar non-commercial content on personal social media or with friends and family is not restricted by this Section. The restriction applies to commercial use and to disclosure of pricing, vendor identification, and itinerary structures designed by Travel King.

10.6 Upon request, Travel King and Client may enter into a separate, more detailed non-disclosure agreement for particular Bookings requiring heightened confidentiality.

11. INDEMNIFICATION BY CLIENT

11.1 Client agrees to indemnify, defend, and hold harmless Travel King, its officers, directors, shareholders, employees, agents, and affiliates from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses, including reasonable attorney’s fees and court costs, arising out of or related to: (a) Client’s acts or omissions; (b) Client’s breach of this Agreement; (c) Client’s failure to comply with Supplier terms, governmental requirements, or travel documentation requirements; (d) misrepresentations or false information provided by Client; (e) any claim by a third party arising from Client’s conduct during or in connection with travel arranged by Travel King; or (f) Client’s use of any service in violation of applicable law.

12. TERMINATION AND REFUSAL OF SERVICE

12.1 TRAVEL KING RESERVES THE RIGHT, AT ITS SOLE AND ABSOLUTE DISCRETION, TO REFUSE TO PROVIDE SERVICES TO ANY CLIENT, OR TO TERMINATE ANY EXISTING ENGAGEMENT WITH ANY CLIENT, AT ANY TIME, WITH OR WITHOUT CAUSE, AND WITHOUT OBLIGATION TO PROVIDE A REASON.

12.2 Without limiting the generality of Section 12.1, Travel King may terminate or refuse service for reasons including but not limited to: Client’s unpaid or delinquent balances; abusive conduct toward Travel King staff or Suppliers; provision of false or misleading information; chargebacks or disputed credit card charges; violation of Supplier terms; suspected fraudulent activity; appearance on sanctions, watch, or other compliance lists; or any conduct Travel King determines, in its sole discretion, to be incompatible with Travel King’s business or values.

12.3 Upon termination by Travel King under this Section, Travel King will refund any unused, refundable balances actually held by Travel King, less Travel King’s service fees (which are non-refundable), less any amounts owed by Client to Travel King, and less any cancellation fees imposed by Suppliers. Travel King has no liability for any consequential damages to Client’s travel plans arising from such termination.

12.4 Sections 4 (Payment Terms), 5 (Cancellation, Changes, and Refunds), 8 (Limitation of Liability), 9 (Force Majeure), 10 (Privacy and Confidentiality), 11 (Indemnification), 13 (Dispute Resolution), and 14 (General Provisions), as well as any other provision that by its nature should survive termination, shall survive the termination of this Agreement.

13. DISPUTE RESOLUTION, VENUE, AND GOVERNING LAW

13.1 Pre-Suit Notice Requirement. Client must provide Travel King with written notice of any claim within sixty (60) days of the event giving rise to the claim. Notice must be sent to Travel King at 111 N. Central Expressway, Suite A, Richardson, TX 75080, or by email to legal@flytravelking.com. Notice must include: (a) the name and contact information of the Client; (b) the specific Booking reference number; (c) the date and nature of the event giving rise to the claim; (d) the specific harm or loss alleged; and (e) the relief sought. Failure to provide complete written notice within sixty (60) days constitutes a waiver of the claim and an absolute bar to recovery.

13.2 Good Faith Resolution Period. Following written notice under Section 13.1, Travel King shall have thirty (30) days to attempt good-faith resolution of the claim before Client may commence any legal action.

13.3 ANY LEGAL ACTION ARISING OUT OF OR RELATED TO THIS AGREEMENT, ANY BOOKING, OR ANY SERVICE PROVIDED BY TRAVEL KING MUST BE BROUGHT EXCLUSIVELY IN THE STATE OR FEDERAL COURTS LOCATED IN COLLIN COUNTY, TEXAS. CLIENT EXPRESSLY CONSENTS TO THE PERSONAL JURISDICTION OF SUCH COURTS AND WAIVES ANY OBJECTION TO VENUE IN SUCH COURTS, INCLUDING ON GROUNDS OF FORUM NON CONVENIENS.

13.4 This Agreement is governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws principles.

13.5 ANY CLAIM AGAINST TRAVEL KING MUST BE COMMENCED WITHIN ONE (1) YEAR OF THE EVENT GIVING RISE TO THE CLAIM. FAILURE TO COMMENCE SUCH ACTION WITHIN ONE (1) YEAR SHALL CONSTITUTE AN ABSOLUTE BAR TO RECOVERY. THIS PROVISION SHORTENS THE STATUTE OF LIMITATIONS THAT WOULD OTHERWISE APPLY UNDER TEXAS LAW.

13.6 CLIENT AGREES THAT ANY CLAIM AGAINST TRAVEL KING SHALL BE BROUGHT ONLY IN CLIENT’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. CLIENT EXPRESSLY WAIVES ANY RIGHT TO PARTICIPATE IN A CLASS ACTION AGAINST TRAVEL KING.

The version of this Agreement in effect at the time of a particular Booking governs that Booking.

14.3 Severability. If any provision of this Agreement is held invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.

14.4 No Waiver. Travel King’s failure to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.

14.5 Assignment. Client may not assign this Agreement or any rights or obligations under it without Travel King’s prior written consent. Travel King may assign this Agreement freely.

14.6 Headings. Section headings are for convenience only and do not affect interpretation.
